SBCH MARKETING PRIVACY POLICY

The Spencer Building Carrier Hotel (“SBCH”) values the relationships we have with individuals and their personal information. We have put in place a number of measures to manage and safeguard your personal information. This Privacy Policy (the “Policy”) describes how SBCH collects, uses, discloses, and protects your personal information in connection with our marketing initiatives, and any related services we provide as described below.

GIVING AND WITHDRAWING YOUR CONSENT

Please read this Policy carefully. By downloading our marketing content, you acknowledge the notices in this Policy. If you do not agree with our Policy and practices, you must refrain from downloading our content.

We collect, use, and disclose your personal information with your consent and as permitted by applicable privacy laws. Depending on the information we collect and the purposes for which the personal information will be used, your consent may be express or implied. When you voluntarily provide personal information to us through our content download form, in response to a promotion, or in response to a marketing questionnaire, we will imply your consent to use and disclose that information for marketing purposes in accordance with this Policy.

If you wish to withdraw your consent to our collection, use, or disclosure of your personal information, please contact us as set out in the “Contact Us” section below. In some cases, withdrawal of your consent may not be possible due to legal obligations or requirements. Withdrawal of your consent may also mean that we will no longer be able to provide certain services to you.

If you withdraw consent relating to your personal information, we may choose to delete or anonymize any or all of your personal information in our system. We may also keep a record of your withdrawal of consent.

COLLECTION OF YOUR PERSONAL INFORMATION

SBCH collects personal information through our content download form. Some collection of personal information outlined below is done by third-party service providers on behalf of SBCH.

SBCH collects the following personal information that you provide to SBCH:

• Contact information: We collect your contact information, including your name, e-mail address, company, and job title through our content download form

USE AND DISCLOSURE OF YOUR PERSONAL INFORMATION

SBCH uses personal information for a number of purposes, as permitted by law. These purposes may be clear to you at the time of collection and may be implied and reasonable in the circumstances. In addition to the obvious business and legal purposes for which we may use personal information, our use of personal information includes the following purposes:

• Sales and marketing: We may use your personal information for various sales and marketing
initiatives related to SBCH services and products.

• Communications: We may use your personal information to correspond with you and to manage our relationship, including in relation to requests you make or to respond to your questions, comments, or concerns. We may use your information to provide you with services, information, or products you request. Where we have your express consent to do so, we may also send you commercial electronic messages, which could include general updates and announcements and electronic newsletters (see below for information on how to “opt-out” of receiving certain communications from us).

We will disclose your personal information to trusted third parties when SBCH services or operations require us to provide your information to a third party who performs functions on our behalf, or in other situations where we are obligated or permitted by law. For example, in certain circumstances, SBCH will disclose your personal information without first obtaining your consent to law enforcement and other governmental authorities when we are required or permitted by law to do so. This could include disclosure for the reporting or investigation of improper or unlawful activities, or to protect SBCH’s rights and property.

Services that we use to perform functions on our behalf include:

• Hosting and software: We use HubSpot CRM to host our sales, marketing, and customer service platform. HubSpot CRM is based in United States, but may transfer data internationally.

• LinkedIn partnership: We use targeted LinkedIn ads to drive viewers to our content download landing page. If LinkedIn users click the link to our content download form from the LinkedIn site, LinkedIn Lead Gen Forms will automatically populate our content download form with the user’s information. If the user submits the content download form to SBCH, we store their data within LinkedIn until it is imported to HubSpot CRM. LinkedIn is based in the United States.

Where you are providing information directly to third party providers who operate on behalf of SBCH, you may be subject to the collection practices and the terms of use and privacy policies of those third parties. You are responsible for reviewing and agreeing to those privacy policies and terms and conditions. If you do not agree with the third-party terms of use or privacy policies, you should not use the services offered by such third-party service providers.

OPTING OUT OF MARKETING COMMUNICATIONS FROM SBCH

We want you to understand your choices and make informed decisions about the ways in which SBCH uses your personal information.

If you provide SBCH with your e-mail address and explicitly consent to receiving messages from us, you may receive commercial electronic communications from us. These messages will provide you with our contact information and a method to opt-out and unsubscribe from future commercial electronic messages.

You can also opt-out of receiving marketing e-mails from SBCH by contacting the Privacy Officer at the details below. If you opt-out, SBCH may still use your e-mail address to communicate with you regarding important matters, such as about services or products that you have purchased. You may not opt-out of receiving communications required by law, or which are necessary to provide you with requested services and/or products.

SECURITY & PROTECTION OF YOUR PERSONAL INFORMATION

SBCH takes reasonable steps to protect your personal information. We use administrative, technical, and physical safeguards to protect against unauthorized access, collection, use, disclosure, and disposal, in a manner appropriate to the sensitivity of the information.

Under some circumstances, we may anonymize or aggregate your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.

ACCESS AND CHANGES TO YOUR PERSONAL INFORMATION

You may request access to, or correction of the personal information held by SBCH about you. Any request must be to the SBCH Privacy Officer in writing at the contact information noted below, with sufficient detail to enable SBCH to understand the request and identify the subject personal information.

When you contact SBCH, we may ask for further information to confirm your identity and the nature of your request. We will respond reasonably to your request and in accordance with the law. In some cases, SBCH may need additional time to respond to a request, in which case we will provide you with written notice of the extension.

SBCH may charge a reasonable fee according to the cost required to retrieve and provide access to the requested information. We may provide an estimate of the fee in advance and in some cases, will require a deposit for all or part of the fee.

CHANGES TO THE POLICY

SBCH may update this Policy from time to time by posting an updating version to our content download landing page. If you download our marketing materials, you acknowledge notice of the most up-to-date version of the Policy posted at that time. SBCH’s collection, use, disclosure, and retention of your personal information will be governed by the version of the Policy currently in effect. As a result, we encourage you to periodically review our Policy for the latest information on our privacy practices and to contact us if you have any questions or concerns.
